TERMS & CONDITIONS OF SERVICE: CAIRN WEDDING FILMS
1. Booking and Payments
1.1. Booking Fee: A non-refundable booking fee of £200 is required to secure the date. No date is confirmed until this fee is received.
1.2. Balance: The remaining balance is due in full no later than 4 weeks before the wedding date.
1.3. Failure to Pay: Failure to pay the balance by the due date will be treated as a cancellation, resulting in the loss of the booking fee.
2. Cancellations and Postponements
2.1. Notice: All cancellations must be made in writing via email.
2.2. Cancellation Fees: * More than 6 months before the wedding: Loss of Booking Fee only.
1–6 months before the wedding: 50% of the total agreed fee.
Less than 30 days before the wedding: 100% of the total agreed fee.
2.3. Postponement: If the wedding is postponed, we will try to accommodate the new date. If the Videographer is unavailable for the new date, it will be treated as a cancellation.
3. Travel and Accommodation
3.1. Included Travel: Travel is included free of charge for weddings within 60 miles of the Videographer’s base.
3.2. Excess Mileage: For weddings beyond 60 miles, a travel fee of 45p per additional mile will be charged.
3.3. Accommodation: For weddings located more than 80 miles from the Videographer’s base, the Client must provide or fund suitable overnight accommodation for the night before and the night of the wedding.
4. Filming and Artistic Licence
4.1. Artistic Style: The Videographer is granted full artistic licence regarding shots and editing style.
4.2. Permissions:The Client is responsible for securing permission to film from the venue and celebrant, including any associated fees.
4.3. Technical Failure: In the unlikely event of total equipment failure, liability is limited to a full refund of all monies paid.
5. Logistics and Equipment Safety
5.1. Meals: For bookings over 5 hours, the Client shall provide a meal for the Videographer, ideally served at the same time as the guests' main dinner.
5.2. Equipment Damage: The Client is responsible for any damage caused to the Videographer’s equipment by guests. The Videographer reserves the right to cease filming if they feel their equipment or person is in danger.
5.3. Delays: If the wedding schedule runs more than one hour late due to circumstances outwith the Videographer's control, an additional fee of £100 per hour may be charged.
6. Copyright and Social Media
6.1. Ownership: The Videographer retains the copyright to all footage captured.
6.2. Promotional Use: The Videographer may use extracts for social media/website portfolios unless the Client opts out in writing.
6.3. Children:Featured footage of children (under 16) will not be used for social media promotion without the consent of a parent or guardian.
6.4. Music: Only licensed music will be used to comply with UK copyright laws.
7. Delivery and Retention
7.1. Timeline: Final films will be delivered within 12 weeks of the wedding date.
7.2. Storage: Raw footage is kept for one year from the wedding date. After this, the Videographer has no obligation to preserve the footage.
8. Force Majeure, Illness and Emergencies
8.1. Acts of God: If the Videographer is unable to perform due to fire, flood, casualty, strike, or other "Acts of God" beyond their control, the Videographer shall return all money paid and this Agreement shall terminate.
8.2. Illness & Emergency: In the event of severe illness, injury, or a personal emergency (e.g., family bereavement) that prevents the Videographer from attending, they will make every reasonable effort to secure a professional replacement of similar style.
8.3. Liability Limit: If a suitable replacement cannot be found, a full refund of all monies paid (including the booking fee) will be issued. This refund represents the absolute limit of the Videographer's liability.
9. Data Protection (UK GDPR)
9.1. We collect personal data solely to fulfill this contract and for statutory tax purposes.
9.2. The Client confirms they have informed guests that filming will take place.
10. Governing Law (Scotland)
10.1. This Agreement is governed by the Laws of Scotland, and the Scottish Courts shall have exclusive jurisdiction over any disputes.
